Kava is intended for adults only. Kava Nectar is a kava root beverage product. Statements on this site about kava and our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on this site is medical advice.
Please read our Kava Safety & Disclaimer page before use. In particular: do not use kava if you are pregnant or nursing, or if you have liver disease or take medications that affect the liver, without first consulting your physician. Do not combine kava with alcohol. Do not drive or operate machinery after consuming kava. Discontinue use and consult a physician if you experience any adverse reaction.
You are responsible for determining whether kava is appropriate for you. By purchasing, you acknowledge that you have read the product information and assume responsibility for your use of the product.
3. Accuracy of Information
We work hard to keep product descriptions, images, pricing, and availability accurate, but we don't warrant that all information on the site is complete, current, or error-free. We reserve the right to correct errors, update information, or cancel orders if any information is inaccurate at any time without prior notice (including after you've submitted an order). Product colors and packaging may vary slightly from images shown.
4. Orders, Pricing, and Payment

- We reserve the right to refuse or cancel any order for any reason, including suspected fraud, resale, errors in pricing or product information, or limits on quantities. If we cancel an order after payment, we'll issue a full refund.

5. Subscriptions
If you choose a "Subscribe & Save" option, you authorize us to charge your payment method at the frequency you select until you cancel. Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund & Return Policy. Both are incorporated into these Terms.

If you submit reviews, comments, photos, or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and display that content in connection with our business, including in marketing. You represent that you own or have the right to share the content, that it's accurate, and that it doesn't violate any third party's rights or any law. We may remove User Content at our discretion. We're not responsible for User Content posted by others.

14. Governing Law and Dispute Resolution
These Terms and any separate agreements under which we provide Services are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Service that can't be resolved informally will be brought exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you have under the consumer-protection laws of your state.
Before filing a claim, you agree to contact us at hello@kavalah.com and give us 30 days to try to resolve the issue informally.
15. Severability; Waiver; Entire Agreement
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions remain in full effect. Our failure to enforce any right or provision isn't a waiver of that right or provision. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
